Contemplating a Divorce? If so, the first thing you should consider is re-writing your will.
At present your will probably leaves everything to your spouse and, in our experience, most people going into a divorce want to change this as the trust has gone from their marriage.
Unlike the act of marriage, divorce doesn’t revoke your Will but whilst you are still married you might still have different wishes regarding your estate and assets as you did when you got married.
To clearly define your estate it might also be necessary to change any property that you own to Tenants in Common, this is because, if you own a property jointly with your spouse, they will automatically be the full owner of that property in the event of your death, no matter what it says in your will!
This is what we suggest you do to best define and protect your assets:
1 - If you own your house Jointly with your spouse, immediately change it to
Tenants in Common, you can do this without their permission, and you can start here, it costs £49 plus disbursements and takes about 3 or 4 days.
2 - You can re-write or
make your will from just £29, this can be done online immediately. You could have a new legal will within 15 minutes ensuring that your loved ones benefit rather than your spouse.
